Liability

The term liability is used to show who is at fault, or at least who is a contributing cause of a car accident or a personal injury.  When you are in an accident, the liability may fall on one, both or more of the drivers involved in the accident. You can figure out liability by who was negligent and contributed to the accident.

Duty Of Care And Negligence

No matter who was responsible for the car accident, there is also a duty of care by everyone who operates a vehicle. The term duty of care refers to the responsibility which all drivers on the road have to act in a safe manner within the laws governing the roads in your area.  Some of these may include but not limited to:

  • Signaling A Turn
  • Maintaining A Safe Distance Between Vehicles
  • Watching For Pedestrians
  • Looking For Obstructions In The Road

If you or another driver does not act in a legal and safe manner, they will be said to be in breach of duty. If you were in breach of duty, and caused an accident or an injury that would mean that you were negligent and liable in the accident.

Joint Fault

Car accidents can sometimes be extraordinarily complicated. This means there could be a combination of factors that cause the accident. Some of these factors could include negligence or breach of duty. This does not have to be limited to one driver. Multiple drivers may be found liable for the accident. In cases like this, the auto accident settlement amount will be figured according to the fault found with each driver.

In cases that are extremely complicated, it is suggested that you speak with an attorney who knows about these auto accident settlement cases, or you may lose out of money that is rightfully yours.

Proving Fault

If you are trying to get car accident compensation, you have to file a car accident settlement claim. When you do this, it is on you to prove fault against the other driver(s).  When you have to prove fault, you have to demonstrate and prove the damages which occurred in the accident happened during the accident or were a direct result of the other individual’s actions. These actions could be negative actions before, after or during the accident.
